TEKNOLOJİNİN MEVZUAT İLE İMTİHANI: SERİ HİBRİT ARAÇLARIN ÖTV POZİSYONU

Otomotiv sektöründeki teknolojik dönüşüm, çevre dostu alternatiflerin piyasadaki payını artırırken, vergi hukukunda da yeni hukuki tartışmaları beraberinde getirmektedir. Bu tartışmaların odağında, hem içten yanmalı hem de elektrikli motora sahip olan hibrit (melez) araçların Özel Tüketim Vergisi (ÖTV) karşısındaki konumlandırılması yer almaktadır. Geçmiş dönem yargı kararlarına yansıyan düşük vergi avantajlarının yerini alan yeni kademeli vergilendirme rejimi, konunun hukuki öngörülebilirlik ve verginin kanuniliği ilkeleri çerçevesinde yeniden ele alınmasını zorunlu kılmaktadır.

1. Hibrit Araçların Vergilendirilmesinde Temel İlke ve Sınıflandırma

Türk vergi yargısının ve idari düzenlemelerin üzerinde uzlaştığı en temel ilke; bir aracın yapısında elektrik motoru barındırmasının, onu tek başına “sadece elektrik motorlu araçlar” kategorisine sokmayacağıdır.

Danıştay 7. Dairesi’nin yerleşik içtihatlarına göre, bir taşıtın elektrik motorunun yanı sıra alternatif bir motor seçeneğine (içten yanmalı motor) daha sahip olması, aracın münhasıran elektrikli araçlara tanınan vergi avantajlarından yararlanmasına engel teşkil eder (Danıştay 7. Daire, E.2025/976, K.2025/2752; E.2025/838, K.2025/2756). Bu doğrultuda bu tür araçlarda vergilendirme rejimi şu esaslara dayanmaktadır:

  • Silindir Hacmi Esası: Hibrit araçlarda vergi matrahı ve oranı belirlenirken, elektrikli motor değil, araçta yer alan içten yanmalı motorun silindir hacmi dikkate alınır.
  • Teknik Fonksiyonun Önemsizliği: İçten yanmalı motorun doğrudan tekerleklere güç verip vermemesi (yani sistemin seri, paralel veya plug-in hibrit olması) vergilendirme usulünü ve tabi olunan kategoriyi değiştirmemektedir.

2. Uygulanan ÖTV Oranları ve Motor Hacmi Kriteri

Hibrit araçlar, 4760 sayılı Özel Tüketim Vergisi Kanunu’na ekli (II) sayılı listenin “Diğerleri” grubu altında sınıflandırılmaktadır. Yargı kararlarına yansıyan somut uyuşmazlıklar ve uygulanan oranlar incelendiğinde net bir tablo ortaya çıkmaktadır:

1600 cm³ ve Altındaki Hibrit Araçlar

Danıştay 7. Dairesi’nin yerleşik kararlarında, örneğin 1497 cm³ silindir hacmine sahip hibrit bir aracın, kanunun ilgili listesindeki “Diğerleri” (Motor silindir hacmi 1600 cm³’ü geçmeyenler) alt başlığında değerlendirilmesi gerektiği ve %80 oranında ÖTV’ye tabi olduğu hükme bağlanmıştır (Danıştay 7. Daire, E.2025/519, K.2025/2754; E.2025/855, K.2025/2755).

Yargının “Kanun Boşluğu” Yaklaşımı: Yüksek mahkeme, 1600 cm³ altındaki hibrit araçlar için özel veya indirimli bir vergi oranının mevzuatta açıkça düzenlenmemiş olmasını bir “hukuki boşluk” olarak görmemektedir. Aksine bu durum, kanun koyucunun bilinçli takdiri ve yasal düzenleme tercihi olarak kabul edilmektedir.

3. Güncel Mevzuatta Vergi Dilimlerinin Dönüşümü: Sadece Elektrikli Araçlar

Vergi politikasında geçmiş yıllarda uygulanan sabit ve sembolik oranlar (örneğin eski kararlarda geçen %10’luk elektrikli araç ÖTV tabanı) tamamen yürürlükten kaldırılmıştır (VDDK, E.2025/20, K.2025/19; Konya BİM 2. VDD, E.2019/1248, K.2020/44) Güncel uygulamada, münhasıran (sadece) elektrik motorlu araçlar için motor gücü ( ) ve vergisiz fiyat (ÖTV matrahı) kriterine dayalı yeni bir kademeli sistem uygulanmaktadır.

Güncel Elektrikli Araç ÖTV Oranları Matrisi

Yeni yasal düzenleme uyarınca taban ÖTV oranı %25’e yükseltilmiş olup güncel baremler şu şekildedir:

  1. Motor Gücü 160 kW ve Altında Olan Elektrikli Araçlar:
    • ÖTV Matrahı (Vergisiz Bedeli) 1.650.000 TL ve altında olanlar: %25 ÖTV
    • ÖTV Matrahı (Vergisiz Bedeli) 1.650.000 TL ve üzerinde olanlar: %55 ÖTV
  1. Motor Gücü 160 kW Üzerinde Olan Elektrikli Araçlar:
    • ÖTV Matrahı (Vergisiz Bedeli) 1.650.000 TL ve altında olanlar: %65 ÖTV
    • ÖTV Matrahı (Vergisiz Bedeli) 1.650.000 TL ve üzerinde olanlar: %75 ÖTV

Kablo ile Şarj Edilebilir (Plug-in) Hibrit İstisnası

Geleneksel (kendi kendini şarj eden) hibrit araçlar %80 vergi diliminde kalmaya devam ederken, çevre politikaları gereği karbon salımı 25 g/km’nin altında ve elektrikli menzili en az 70 km olan şarj edilebilir (Plug-in Hybrid) araçlar için yasaya yeni teşvik oranları eklenmiştir:

  • Motor hacmi 1600 cm³’ü geçmeyen ve matrahı 1.350.000 TL’yi aşmayanlar: %30 ÖTV
  • Motor hacmi 1600 cm³’ü geçmeyen ve matrahı 1.350.000 TL’yi aşanlar: %60 ÖTV
  • Motor hacmi 1600 cm³ ile 1800 cm³ arasında olup matrahı 1.350.000 TL’yi aşmayanlar: %70 ÖTV

4. Hukuki Tartışmalar ve Karşı Görüşler: Kıyas Yasağı ve Kanunilik

Mevcut çoğunluk görüşü hibrit araçları silindir hacmine göre “Diğerleri” kategorisinde vergilendirse de, yargı kararlarında dikkat çekici muhalefet şerhleri (karşı oylar) yer almaktadır.

Danıştay 7. Dairesi bünyesindeki bazı karşı oy gerekçelerinde; hibrit araçların teknik yapısı, çalışma prensipleri ve emisyon avantajlarının kanunda açık, net ve spesifik olarak düzenlenmediği ileri sürülmüştür (Danıştay 7. Daire, E.2025/229, K.2025/2753). Bu teknik farklılığa rağmen, araçların doğrudan genel “Diğerleri” kategorisine dahil edilerek yüksek oranlara tabi tutulmasının, Anayasa’nın 73. maddesinde güvence altına alınan “verginin kanuniliği” ilkesini ve vergi hukukunun en temel direktiflerinden biri olan “kıyas yasağı” kuralını zedeleyebileceği savunulmuştur. Ancak yeni mevzuatın yavaş yavaş “şarj edilebilir hibrit” gibi kavramları kanun metnine eklemesi, bu karşı oylarda belirtilen hukuki belirsizlikleri gelecekte tamamen ortadan kaldırmaya yönelik olumlu adımlardır.

5. Araç Sahipleri ve Alıcıları İçin Yönlendirmeler: Hukuki ve Finansal Yol Haritası

Yargı kararları ve güncel mevzuat ışığında, hibrit veya elektrikli araç almayı planlayan ya da halihazırda almış olan vatandaşların şu pratik adımlara dikkat etmesi gerekir:

Aksesuar Faturalandırmasını Ayırın: Araçla birlikte eş zamanlı kesilen aksesuar faturaları ÖTV matrahına dahil edilmektedir. Aracın matrahını suni olarak yükseltip üst vergi dilimine (%25’ten %55’e veya %30’dan %60’a) girmesini önlemek adına, opsiyonel donanım ve aksesuarları mümkünse araç tescil edildikten sonra bağımsız bir fatura ile satın alın.

Teknik Belge (CoC) Kontrolü Yapın: Şarj edilebilir (Plug-in) hibrit teşvikinden (%30 veya %60 ÖTV) yararlanabilmek için, aracın teknik uygunluk belgesinde karbon salımının 25 g/km’nin altında ve elektrikli menzilinin en az 70 km olduğunu bayiden mutlaka teyit edin. Aksi halde araç doğrudan %80 ÖTV’ye tabi tutulur.

İhtirazi Kayıtla Beyan ve Dava Hakkı: Şahsi veya ticari araç ithalatında gümrük idaresinin doğrudan en yüksek orandan (%80) vergilendirme yapması halinde, gümrük beyannamesine ihtirazi kayıt koyarak 30 gün içinde Vergi Mahkemesinde dava açabilirsiniz. Davada, Danıştay 7. Dairesi’ndeki “kıyas yasağı” ve “verginin kanuniliği” yönündeki güçlü karşı oy gerekçelerini (E.2025/229, K.2025/2753) emsal gösterebilirsiniz.

Tüketici Hakları ve Tazminat: Satış sürecinde bayi tarafından “düşük vergiye tabi” olduğu beyan edilen ancak sonradan yüksek ÖTV uygulandığı anlaşılan araçlar için adli yargıda bayi/üretici aleyhine “ayıplı hizmet ve gizli ayıp” kapsamında maddi tazminat davası açma hakkınız mevcuttur (Yargıtay HGK, E.2018/320, K.2021/1394).

Sonuç: Türk vergi yargısının yerleşik içtihatları, hibrit araç vergilendirilmesinde “teknik karma yapıya” değil, “içten yanmalı motor mevcudiyetine” odaklanmaktadır. Kanun koyucu, elektrikli araçlardaki %10’luk taban vergi oranını kaldırıp alt sınırı %25’e çekerken, hibrit dünyasında sadece “Plug-in” (şarj edilebilir) teknolojisine özel kademeli geçiş hakkı tanımıştır. Mevzuatın gelişim yönü, Danıştay’ın “boşluk yoktur, kanun koyucunun takdiri vardır” yönündeki kararlarını haklı çıkarmakta; vergi idaresinin çevre dostu araçları vergilendirirken matrah ve motor gücü ( ) dengesini daha sıkı gözettiğini ortaya koymaktadır.
